As our Monday editorial details, there is every reason to believe that the eventual ruling of the Ninth Circuit federal appeals court will control the outcome of litigation over President Trump’s temporary travel ban on both aliens from seven countries and refugees. A three-judge panel of the Ninth Circuit is considering the Justice Department’s appeal of a temporary restraining order issued by Seattle federal district judge James Robart, which suspends the ban. The panel has announced that it will hear oral argument on Tuesday.
The Ninth Circuit’s determination is likely to be dispositive because there are currently only eight justices on the Supreme Court, a situation that will obtain until the vacancy created by Justice Scalia’s death is filled. It is assumed that the four left-wing justices on the Court (Justices Ginsburg, Breyer, Sotomayor, and Kagan) would vote to uphold Judge Robart’s lawless restraining order. I believe that is an entirely reasonable assumption because, as I’ve been arguing for years now, the Supreme Court operates more like an unelected super-legislature than a judicial tribunal. A recent analysis conducted by Third Way — a self-described “centrist” think tank — argues that Democrats are evolving into a “coastal” party. They have strong bases in California, New York and Massachusetts but are slowly ceding the rest of the country to Republicans.

Senate Majority Leader Mitch McConnell (R-KY) said he would not spend federal funds investigating what President Trump says is “massive voter fraud in the 2016 presidential election.”
McConnell told CNN’s Jake Tapper that, although there are instances of voter fraud, he believes that it’s not “as widespread as Trump claims” and that combating voter fraud should be an issue “best left to the states” instead of the federal government.

Who knew that Obamacare provides for a “Regular Corps” and a “Ready-Reserve Corps” of officers and individuals who are appointed by the president? Commissioned officers are subject to active duty at the call of the surgeon general. The new law provides $17.5 million in each of the first four years to recruit and train these reserves.
During his campaign, Obama said: “We cannot continue to rely only on our military. … We’ve got to have a civilian security force just as powerful, just as strong, just as well-funded. We cannot continue to rely only on our military in order to achieve the national security objectives we’ve set.”
Section 5210 of the Patient’s Protection and Affordable Care Act (aka Obamacare) may be the beginning of Obama’s civilian security force. This section amends Section 203 of the U.S. Public Health Service Act. Why it was included in the massive health-care bill is a question in search of meaningful answers. Reported rapes in Denmark double in two years
A record 744 rapes were reported in Denmark last year, doubling the number of reports in 2014 according to figures from Statistics Denmark that were first reported by Metroxpress.
According to a consultant to the Danish National Police, the sharp increase is due in part to police districts better recording rape reports.
“We are very pleased that we now have more accurate numbers on how many men and women have reported rapes. Previously there were many cases that were treated under the category of ‘investigation numbers’ that did not get included in the statistics of reported rapes,” Thomas Brædder told Metroxpress.
Last year it was reported that an investigation by the Ministry of Justice indicated that as many as 700 rape cases per year were being filed incorrectly by police.
The majority of the ‘missing' reports were hidden in police statistics by giving them investigation numbers that did not classify them as rape cases. A number of police departments confirmed to Metroxpress that this was standard practice in cases where there was doubt as to whether a rape had actually occurred.
That practice was discontinued in November 2015, so the 2016 rape report figures from Statistics Denmark represent the first full year under the improved reporting.

How to Spot a Fake Science News Story | American Council on Science and Health
After more than six years in science journalism, I have reached two very disturbing conclusions about the craft.
First, too many science journalists don't actually possess a well-rounded knowledge of science. In many cases, regular reporters are asked to cover complex science and health stories. What we end up with is entirely predictable: Articles that are nothing more than rehashed press releases, topped with click-bait headlines based on exaggerations and misunderstandings of the original research. That's how a nonsensical story like Nutella causing cancer goes viral.
Second, science journalists are every bit as biased as their more traditional counterparts, perhaps even more so. They routinely hold double standards in regard to analyzing science policies. They conflate scientific evidence with science policy, immediately labeling anyone "anti-science" if he or she disagrees with their cultural beliefs. Worse, science journalists feel no inhibition whatsoever to cheerlead openly for their favorite politicians and to heap scorn upon those they dislike. Just read Twitter.

Teacher compares 7th-grader's pro-Trump T-shirt to swastika
Michelle Fischer’s seventh-grade son Jack has been a supporter of Republican President Donald Trump for quite some time. He was very interested in and followed the primary elections last year in the news cycle with his parents, she explained on her Facebook page.

Christian McKneely said he was messing around in his high school classroom in Houston last week when he told another student: “That’s gay.”
McKneely’s teacher apparently didn’t like that.
He said his teacher accused him — and Christians in general — of homophobia, KPRC-TV reported. McKneely added that his teacher punched him in the chest when he was on his cellphone trying to tell his father what had occurred, the station reported.
In addition to last Wednesday’s alleged incident, McKneely said the teacher offered students extra credit for going to an anti-Trump demonstration during the presidential campaign, KPRC reported.
“She gave extra credit for anyone who showed up for an anti-Trump rally being held downtown,” McKneely said during a Monday press conference outside Sterling High School. “I didn’t go, so I didn’t get extra credit. I don’t know if anybody got it, but that’s what she proposed for extra credit.”
The Houston Independent School District told KPRC only that it received reports of possible mistreatment of a student by a teacher at the school.

WASHINGTON – The Trump administration is considering a plan to weed out would-be immigrants who are likely to require public assistance, as well as to deport — when possible — immigrants already living in the U.S. who depend on taxpayer help, according to a draft executive order.
A second draft order under consideration calls for a substantial shake-up in the system through which the United States administers immigrant and nonimmigrant visas, with the aim of tightly controlling who enters the country and who can enter the workforce, and reducing the social services burden on taxpayers.
The drafts are circulating among administration officials, and it is unclear whether President Donald Trump has decided to move forward with them or when he might sign them if he does decide to put them in place. The White House would not confirm or deny their authenticity.
If enacted, the executive orders would appear to significantly restrict all types of immigration and foreign travel to the U.S., expanding bars on entry to the country that Trump ordered last week with his temporary ban on refugees and people from seven Muslim-majority countries.
In 2014, Minnesota spent more than $31 million in food or cash assistance and $137 million in medical assistance for residents who came as refugees, including some federal dollars — about 2 percent of its overall tab for such programs. Let’s agree that President Trump’s travel ban on visitors from seven nations was a sensible idea hobbled by flaws, especially regarding green card holders and dual citizens. Let’s also agree we haven’t seen a rollout this clumsy since the debut of ObamaCare, which was far more serious because it penalized millions of Americans while Trump’s order inconvenienced hundreds of foreign nationals.
Still, we can assume, based on past performance, that Trump will learn from the mistakes. His fierce determination to be a successful president cannot co-exist with rookie blunders.
But what about the other players in the drama? Can we say the media will now correct its excess of bile and cover Trump as a legitimate president and not as an invasive species?
No, no, no. On the contrary, we must say that Trump aide Steve Bannon was on target when he called the Washington media “the opposition party.”
Don’t take his word for it. Stick a toe into the toxic sludge that passes for straight-news coverage in the Washington Post, the New York Times and others.
Look for the use of tell words like “Muslim ban” to describe an executive order that is no such thing. Look for hero worship of protesters, immigrants, refugees, lawyers rushing to the barricades and congressional critics.
Look, too, at the Twitter feeds of editors and reporters from those papers and the major networks. You’ll see their embrace of everything anti-Trump, further evidence they are part of a movement to obstruct the president, not cover him.
Consider, too, their rediscovered love for Republican Sen. John McCain, a man they ignored during the eight-year reign of their savior, Barack Obama. McCain is again the good maverick because he is bucking the media’s permanent enemy, Republicans.
Yet if the media is the opposition party, what is the Democratic Party? It’s supposed to be the loyal opposition, using checks and balances to restrain the president and the excess of one-party rule. Vigorously praised by the National Rifle Association, Neil Gorsuch “has endorsed Second Amendment rights,” says FiveThirtyEight. However, there is one ruling that gives some conservatives concern, relating to when police can disarm those carrying firearms.
Although Gorsuch’s positions on some hot button issues – like abortion – are less clear, his stances on the Second Amendment and guns are clearer.
Trump chose Gorsuch, 49 – a Denver appellate judge who is known as an “originalist” – to replace the late conservative justice Antonin Scalia.
